BIOMETRIC POLICY

SocialChain, Inc’s Biometric Policy and Release (“Biometric Policy”) describes how SocialChain, Inc., its parent, and affiliates, (collectively, “Pi,” “we,” “our,” or “us”) treat the photos and/or video images of your face collected from the Pi Network mobile application, the Pi Browser mobile application, the Pi Node desktop software, Pi applications on Pi Apps Platform including Pi Wallet, Pi KYC, Pi Developer portal and the website, https://minepi.com/ (the “Site”), and identity verification services through PiVerify provided to our Clients as detailed in our Privacy Policy (“KYC Services”), including scans of facial geometry extracted from those images and palm prints, each of which may be considered “biometric identifiers,” “biometric data,” or “biometric information” (collectively, “Biometric Data”) under applicable law in some jurisdictions. This Biometric Policy applies to the Site, applications, products and services (collectively, “Services”) on or in which it is posted, linked, or referenced.
By using the Services, you accept the terms of this Biometric Policy, our Terms of Use, and Privacy Policy, and consent to our collection, use, disclosure, and retention of your Biometric Data as described in this Biometric Policy. The Terms of Use contain provisions that limit our liability to you and require you to resolve any dispute with us on an individual basis through arbitration and not as part of any class or representative action. IF YOU DO NOT AGREE WITH ANY PART OF THIS BIOMETRIC POLICY, OUR TERMS OF USE, OR PRIVACY POLICY, THEN PLEASE DO NOT USE ANY OF THE SERVICES.
Purpose of Processing
We conduct our own identity verification processes and also provide identity verification services to our Clients as described in the Privacy Policy (available at the following link https://socialchain.app/privacy). In conducting such identity verification we and/or our service providers collect and process the image from your identity document and your photograph or video image provided to us directly by you, at our customer’s instruction, to derive a scan of your facial geometry using facial recognition or similar technology in order to provide our customers with identity verification and fraud prevention services. We and/or our service providers may also process and use your photograph or video image for fraud detection and prevention services, including to determine whether your photograph or video image depicts a real person. Your identity document image, photograph, or video image, and any derived facial geometry scan from those images, may be considered Biometric Data in some jurisdictions. Such information may be disclosed to our service providers for the purpose of providing the Services and KYC Services. In relation to the KYC Services, where we serve as a service provider, as defined by applicable law, our Clients instruct us to process, store, retain, or delete your identity document and/or photograph or video image. In providing the KYC Services, we do not share your facial scan data with Clients. Based on the results of its comparison, we may advise Clients whether your identity was verified, has previously been verified, and/or whether any indicators of fraud were detected. We do not sell, trade, or lease your facial scan data.
We and/or our service providers will collect, process, obtain, use, and store your identity document image, photograph, or video image for the purpose of:
If you do not provide an identity document with an image of your face or a photograph and video image of yourself, We and/or our service providers will not process your images to derive your facial geometry data to compare your identity document to your photograph or video image. We will retain a record of your partially completed verification process in accordance with customer’s instructions, unless otherwise required by law or legal process.
Retention, Storage, Security and Deletion
If you have created a Pi Network Account subject to the Terms of Use (available at the following link https://socialchain.app/tos) and saved your identity verification information, we may store at your instruction, one or more identity document(s) containing facial imagery that you provide. We do not ever process the image from these identity documents for additional purposes unless instructed to do so by you. You can learn more about how to delete your stored identity document(s) in your Pi Network or PiVerify Account by contacting us through https://prighter.com/q/16457313501 for those EU/GDPR Users, and for US based Users by contacting us at privacy@minepi.com. Notwithstanding any indication to the contrary in our Terms of Use (available at the following link https://socialchain.app/tos), this Biometric Policy shall prevail in the event of any inconsistency with other terms or notices provided to you.
We and/or our service providers may permanently destroy and delete any identity document and/or photograph or video image, and any facial geometry obtained thereof, within a reasonable time after the initial purpose for collecting it is satisfied or, where required by applicable law, upon your request, unless retention is required by law or legal process, or to comply with our legal, regulatory, compliance, fraud-prevention, or record-keeping obligations (including identity verification and anti-money-laundering requirements).
We implement appropriate technical and organizational measures to keep information you provide us secure and contractually require our service providers to do the same. The image from your identity document, photograph, or video images of your face, and your derived facial geometry, if applicable, are stored in an encrypted format by us and/or our service providers on behalf of our customers. We store, transmit, and protect such information in a manner that is the same as or more protective than the manner in which we store, transmit, and protect other confidential and sensitive information.
Additional Terms
We and/or our service providers only use and process your image from your identity document and/or photograph or video image in accordance with this Biometric Policy, and for no other reasons. We do not sell or otherwise profit from Biometric Data. We are not responsible for the policies or practices of its customers. Please see our Privacy Policy (available at the following link https://socialchain.app/privacy) to understand how we collect and use your Personal Information on behalf of our customers. We encourage you to also review our customers’ privacy policies and any applicable terms and conditions which may apply to their use of your data, some of which may be considered Biometric Data in your region.
By using our identity verification and fraud prevention services (either with Pi KYC or as a customer of our Client’s using PiVerify), you agree that any identity documents or photographs and video images you provide to verify your identity with our customers are (1) authentic, (2) submitted identity documents are your own government-issued identity documents, and (3) any submitted identity documents, photographs, or video images accurately depict your face and only your face in the photograph or video image that you provide.
You agree that you have read, understand, and voluntarily consent to this Biometric Policy and that you release in favor of us and/or our service providers any claims related to the collection, processing, use, disclosure of, or sharing of your identity document and your photograph or video image, including any data derived from these images to create a facial geometry scan; and you confirm that you are not accessing the Services in any jurisdiction where those services are not permitted by applicable law.
